Welcome to HackAIGC ("HackAIGC", "we", "our", or "us"). These Terms of Service ("Terms") govern your access to and use of our website, applications, APIs, and related services (collectively, the "Services").

By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Services.

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is higher) to access or use the Services.

By using HackAIGC, you represent and warrant that:

You meet the applicable age requirement;
You have the legal capacity to enter into this agreement;
Your use of the Services complies with all applicable laws and regulations.

2. AI Generated Content

HackAIGC provides artificial intelligence tools capable of generating text, images, videos, and other content based on user prompts.

All generated content is produced automatically by artificial intelligence and may:

contain inaccuracies or errors;
be fictional or misleading;
produce unexpected or offensive outputs.

AI-generated content does not represent the opinions or views of HackAIGC. Users are solely responsible for reviewing, verifying, and using any generated content. HackAIGC does not provide legal, financial, medical, or professional advice through its AI systems.

3. Acceptable Use

You agree not to use the Services to:

violate any applicable law;
facilitate fraud, scams, or deceptive practices;
create or distribute malware, phishing materials, or malicious software;
promote terrorism or violent extremism;
harass, threaten, or abuse others;
infringe intellectual property rights;
invade another person's privacy;
impersonate another individual without authorization;
distribute illegal content.

4. Deepfake and Real Person Content

HackAIGC strictly prohibits the use of its Services to:

generate or distribute sexually explicit content involving real persons;
create non-consensual intimate imagery;
generate deceptive deepfake content intended to impersonate identifiable individuals;
violate publicity, privacy, or personality rights.

Users may only generate fictional characters or content for which they possess all necessary legal rights. Violation of this policy may result in immediate account suspension or termination without refund.

5. Adult Content

HackAIGC permits certain fictional adult-oriented content where lawful.

The following content is strictly prohibited:

child sexual abuse material (CSAM);
any depiction involving minors or age ambiguity;
incest;
bestiality;
sexual violence;
non-consensual sexual acts;
human trafficking or exploitation;
illegal pornography under applicable law.

HackAIGC reserves the right to remove prohibited content and suspend offending accounts.

6. User Responsibility

You are solely responsible for:

all prompts you submit;
all uploaded content;
all generated outputs you choose to use;
ensuring compliance with applicable laws.

HackAIGC does not pre-screen every prompt or generated output.

7. Intellectual Property

You retain ownership of your original prompts and any content you upload. Subject to applicable law, you may use AI-generated outputs commercially. You represent and warrant that any uploaded materials do not infringe any third-party intellectual property rights.

8. User Content License

By uploading content to HackAIGC, you grant HackAIGC a limited, non-exclusive, worldwide license solely to:

process uploaded materials;
generate requested outputs;
operate and improve the Services where permitted by our Privacy Policy.

HackAIGC does not claim ownership of your uploaded content.

9. Accounts

You are responsible for maintaining the confidentiality of your account credentials. You are responsible for all activities conducted under your account. HackAIGC reserves the right to suspend or terminate accounts involved in fraud, abuse, payment violations, or breaches of these Terms.

10. Payments

Certain Services require payment. By purchasing subscriptions or credit packages, you agree to pay all applicable fees. Except where required by law, all purchases are non-refundable. HackAIGC may change pricing for future purchases at any time.

11. Subscription and Auto-Renewal

Subscriptions automatically renew at the end of each billing cycle unless canceled before the renewal date. By purchasing a subscription, you authorize recurring charges to your selected payment method. You may cancel auto-renewal at any time through your account settings. Cancellation prevents future renewals but does not refund the current subscription period except where required by law.

12. Refund Policy

Unless otherwise required by applicable law, purchases of subscriptions and credit packages are non-refundable. Refund requests may be considered at HackAIGC's sole discretion. Accounts terminated for violations of these Terms are generally not eligible for refunds.

13. AI Safety Policy

HackAIGC is committed to maintaining a safe and lawful platform. To help protect our users, payment partners, and the public, HackAIGC may use automated systems and, where appropriate, human review to detect content or activities that may violate these Terms or applicable laws.

We reserve the right to:

restrict or remove content;
suspend or terminate user accounts;
investigate suspected abuse or fraud;
cooperate with lawful requests from competent authorities where legally required.

HackAIGC is under no obligation to monitor all user activity but may take action whenever violations are identified.

14. Chargeback and Payment Abuse

Users agree not to engage in fraudulent or abusive payment practices, including but not limited to:

unauthorized chargebacks;
bad-faith payment disputes;
stolen payment methods;
payment fraud;
attempts to evade payment obligations.

HackAIGC reserves the right to:

suspend or permanently terminate accounts;
revoke access to purchased Services;
recover unpaid balances where permitted by law;
refuse future purchases from users engaging in payment abuse.

Repeated or fraudulent chargebacks may be reported to payment processors and fraud prevention services.

15. Service Availability

HackAIGC does not guarantee uninterrupted or error-free operation of the Services. The Services may be modified, suspended, or discontinued at any time without prior notice.

16. Disclaimer of Warranties

The Services are provided on an "AS IS" and "AS AVAILABLE" basis. To the fullest extent permitted by law, HackAIGC disclaims all warranties, whether express or implied, including but not limited to:

merchantability;
fitness for a particular purpose;
non-infringement;
uninterrupted availability;
accuracy or reliability of generated content.

17. Limitation of Liability

To the fullest extent permitted by law, HackAIGC, its affiliates, directors, officers, employees, licensors, and partners shall not be liable for:

indirect damages;
incidental damages;
consequential damages;
special damages;
punitive damages;
loss of profits;
loss of business opportunities;
data loss.

HackAIGC's total liability for any claim arising from the Services shall not exceed the total amount paid by the user during the twelve (12) months preceding the claim.

18. Indemnification

You agree to defend, indemnify, and hold harmless HackAIGC, its affiliates, directors, officers, employees, licensors, and partners from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

your use of the Services;
your violation of these Terms;
your violation of applicable law;
your infringement of any third-party rights.

19. Privacy

Your use of the Services is also governed by our Privacy Policy. By using the Services, you acknowledge that HackAIGC may collect, process, and store information as described in the Privacy Policy.

20. Termination

HackAIGC may suspend or terminate your access to the Services immediately, with or without notice, if:

you violate these Terms;
fraudulent activity is suspected;
payment abuse occurs;
required by law;
continued access may expose HackAIGC or its partners to legal or security risks.

Termination does not relieve you of any outstanding payment obligations incurred before termination.

21. Changes to These Terms

HackAIGC reserves the right to modify these Terms at any time. Updated Terms become effective immediately upon publication unless otherwise stated. Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms.

22. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

23. Governing Law

These Terms shall be governed by and construed in accordance with the laws applicable to the legal entity operating the Services, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts having jurisdiction over the operating entity unless otherwise required by applicable law.
